How to Search Civil Dockets
First, pick the court. The Magistrate Case Record Search covers lower-court civil claims. Meanwhile, WVPASS covers public Circuit and Family Court case information. An exact number works best. A Circuit civil number can look like CC-36-2017-C-7. There, 36 identifies Pendleton County and C marks the civil case type.
Searching by name takes more care. Before choosing a result, check the party roles, filing dates, court, and case style. Family Court follows special confidentiality rules, even when an order or index entry is public.
- Identify Magistrate, Circuit, or Family Court.
- Open the matching portal from the state access hub.
- Search the exact case number or a party name.
- Review service, filings, motions, settings, and disposition.
- Request an official or certified item from its clerk.
Pendleton Civil Docket Jurisdiction
Under current W.Va. Code §50-2-1, Magistrate Court hears civil claims of not more than $20,000. The statute lists exclusions. Equity, eminent domain, disputed title, false imprisonment, malicious prosecution, and slander or libel are all excluded. Magistrates still handle small claims, commercial credit, detinue, and unlawful detainer. That holds when title is not disputed. Circuit Court keeps broader original jurisdiction and hears Magistrate appeals.
Use the current law. Older annual-report text refers to a limit below $10,000. The current statute says not more than $20,000, so the older narrative is not the present rule.
The claim amount alone does not settle venue. Relief sought, disputed title, an appeal, or other statutory limits can place a Pendleton County civil case in Circuit Court instead. The court name on the docket is the safest routing fact.
What a Civil Docket Shows
A Pendleton County civil docket can list the case number and style, filing date, parties, complaint, summons, service attempts, motions, notices, hearing events, payments, judgment amount, costs, interest, and final orders. Magistrate detail fields may show whether service was attempted or a judgment was entered. They may not include every pleading or a certified judgment image.
| Case number | The court identifier, year, type, and sequence. |
|---|---|
| Parties | Plaintiff and defendant roles in the public index. |
| Service | Summons issued and successful or unsuccessful service events. |
| Motions and hearings | Requests for court action and scheduled event data. |
| Judgment | Amount, date, status, costs, and interest when published. |
The docket is a chronology. Read the final judgment alongside later payment, enforcement, appeal, release, or satisfaction entries, because one field may not reflect the complete Pendleton County civil file.
Pendleton Civil Docket Service Trail
Service entries tell the court record how notice was attempted or completed. In the state Magistrate sample, codes distinguish certified mail, a summons issued, and an unsuccessful attempt. Some codes mark Secretary of State service. Others show successful service. A notice of hearing can follow. Motions, a final judgment, and an order on civil judgment may appear later. The sequence matters, since a judgment field alone does not explain notice or procedure.
The Magistrate detail interface shows the fields used for charges or claims. Judgments, events, parties, and docket entries have fields too.

That layout is the reason to read a Pendleton County civil docket from the first filing through the latest entry. One amount or status line is never the whole story.
Pendleton Civil Docket Case Numbers
Pendleton Circuit civil numbers use county code 36. Official orders show formats such as CC-36-2017-C-7 and CC-36-2017-C-9. That code separates a Circuit civil matter from a Magistrate claim. It also narrows a WVPASS search far better than a party name alone.
Keep the complete number when requesting a copy or asking about a setting. A related Magistrate appeal or recorded judgment can carry a different identifier. Compare court name, filing year, case type, and sequence. Only then treat two entries as part of the same Pendleton civil docket.
Types of Civil Cases on the Docket
Civil dockets in Pendleton County span several courts and claim types. Magistrate Court handles civil work within its present jurisdiction. Circuit Court hears broader civil actions plus lower-court appeals. Family Court covers divorce, custody, support, paternity, visitation, name changes, and related domestic matters, though public access to those files is narrower.
- Small claims and commercial credit matters.
- Detinue actions seeking return of personal property.
- Unlawful detainer when title is not disputed.
- Circuit contract, tort, property, and appeal matters.
- Domestic matters whose orders or indexes are public.
A probate or land-record question may belong with the County Clerk instead. That office is not the general custodian of Pendleton County Magistrate, Circuit, or Family Court dockets.
Pendleton Civil Docket Judgment Records
A court judgment and a recorded judgment index entry are related but not interchangeable. The Pendleton County civil docket holds the case activity plus the judgment or order. The County Clerk describes a Document Inquiry. It includes judgments along with deeds, probate records, releases, and wills. That county-recording index can help find an abstract, lien, release, or book and page. Recording dates appear there too.
| Source | Best for | Custodian |
|---|---|---|
| Court docket | Complaint, service, motions, hearings, judgment | Magistrate or Circuit Clerk |
| County index | Recorded judgment, lien, release, book and page | County Clerk |
Use both tools when tracing enforcement or release. Confirm the court judgment with the court clerk and the recorded instrument with the County Clerk. Neither search replaces the other.
The county-linked IDX Search shows the recording system's date and name controls.

That interface belongs to county recording research, while a Pendleton County civil docket stays in the court system.
Pendleton Civil Docket Family Limits
Family Court cases count as civil, yet their files play by different access rules. Family Rule 6 keeps orders and indexes public. The rest is confidential, including pleadings, recordings, exhibits, transcripts, and many other documents. West Virginia Code §48-1-303 draws much the same line. Domestic-relations orders stay public while the underlying file material stays protected. So a public index entry never opens the whole Pendleton family file. Parties and others with standing use the access route the rule sets out. A different requester may need a good-cause court order. Ask the Circuit Clerk about any specific document's status. Do not hunt for a way around the restriction.
Settings and Hearings on Civil Dockets
A civil setting on the docket can show up as a notice, motion, event schedule, conference, hearing, or trial. A Magistrate detail event lists its type, date and time, room, location, and judge. It also shows whether the event is closed. That word "closed" means only that the event ended. It reveals no result. Nor does it prove the case itself is over. A continuance, cancellation, amended notice, or later order can still control. Pull the exact Pendleton County case number and read the newest docket entries. Match the portal against the notice or order a party received. When the public display is unclear, call the right clerk. Use the Circuit Clerk for a Circuit or Family setting. Use the Magistrate Clerk for a Magistrate one. The Pendleton County court calendar offers a wider date-check route, including the separate court-closure check.
Note: A term date or general calendar pattern does not confirm that a specific civil case will be heard that day.
Pendleton Civil Docket CourtPLUS Shift
Pendleton County joined CourtPLUS and West Virginia E-File on October 1, 2018. State e-filing rules say an electronic receipt completes filing. The e-file stamp carries official entry effect. The electronic register serves as the official docket, subject to seal and confidentiality limits. Self-represented litigants may still file at the Circuit Clerk. Staff there enters covered papers electronically. Sealed underlying documents follow a paper-filing rule instead. The official CourtPLUS overview describes the unified system and its service channel.

That overview ties the filing technology to the Pendleton County civil docket. Public access still turns on the case and the document's status. The official status table records Pendleton's deployment date.

The status image fixes the date Pendleton joined CourtPLUS. That timing explains why older and newer civil files can carry different electronic histories.
Public Access to Civil Dockets
W.Va. Code §51-4-2 opens court papers and records unless another law says otherwise. Trial Rules 10.03 and 10.04 govern the limits. The rules also cover custodian requests, inspection during usual business hours, electronic format, and actual reproduction costs. A court may restrict a civil file by order. But the order must state the nature, duration, and reason. What is online is not the full measure of lawful access.
Access boundaries:
Family Rule 6 makes orders and indexes public while treating many pleadings, exhibits, recordings, and transcripts as confidential.
W.Va. Code §29B-1-4 includes exemptions and an unreasonable-invasion-of-privacy limit.
Trial Rules 10.03–10.04 govern limited files and custodian access.
To inspect a file in person, staff generally retrieves the original and provides a supervised area. The public never handles originals uncontrolled. Call ahead so the Pendleton clerk can confirm an open file is on hand.
Pendleton Civil Docket Certified Judgments
A portal result or download does not arrive certified on its own. For a certified Pendleton County civil judgment, contact the proper clerk. Give the case number and the document name and date if known. Also give the required certification and your delivery method. Ask the current fee before paying. No single Pendleton-specific certification fee exists. W.Va. Code §59-1-11 lists general clerk charges. Those include $1 per page for specified copies and papers. The Circuit Clerk Procedural Manual sorts out inspection, ordinary copies, and certified or attested copies. WVPASS charges $0.25 per page for document access. Those downloads are expressly not certified. MCR detail is likewise only a public information display. Bring Circuit and Family files to the Pendleton County Circuit Clerk. Bring Magistrate files to the Magistrate Clerk. The Circuit Clerk office page gives the current contact route. Clerk staff can explain procedure and cost, but never legal advice on enforcement or appeal.
Pendleton Civil Docket Filing Context
The official 2024 lower-court report counted 50 civil filings in Pendleton Circuit Court. That annual aggregate is no live pending-case count. It cannot say whether a named case remains open. It cannot say whether the case ended in judgment, settled, or moved on appeal. Treat it as a measure of scale only. Anyone tracking one Pendleton County civil docket still searches by court and case number. Statistics cannot replace the case register, the filed order, or clerk confirmation.
